Become a JosongTech Affiliate

1. Program Overview

The JosongTech Affiliate Program ("Program") allows individuals and businesses ("Affiliates") to earn commissions by referring clients to JosongTech's services. By participating in this Program, you agree to these Terms and Conditions.

This Program is designed to be fair, transparent, and mutually beneficial. We value our affiliates and aim to provide competitive compensation for successful referrals.

2. Eligibility

2.1 Who Can Join

To be eligible for the Affiliate Program, you must:

• Be at least 18 years of age
• Have a valid email address and contact information
• Have a legitimate online presence (website, social media, email list, etc.) or network through which you can promote our services
• Comply with all applicable laws and regulations
• Not be a direct competitor of JosongTech
• Not have been previously terminated from the Program for violation of these terms

2.2 Application Process

To join the Program, you must submit an application through our contact form or by emailing us directly. We reserve the right to approve or reject any application at our sole discretion. We may request additional information to verify your eligibility.

3. Commission Structure

3.1 Commission Rate

Affiliates will earn a commission based on a percentage of the net profit made from referred clients. The standard commission rate is up to 15% of the profit, though specific rates may vary based on:

• The type of service or project referred
• The total value of the project or service subscription
• Your affiliate tier and performance history
• Other factors as determined by JosongTech

Commission rates will be clearly communicated and agreed upon when you are accepted into the Program.

3.2 What Qualifies for Commission

A commission is earned when:

• A potential client clicks on your unique affiliate link
• The client contacts JosongTech and mentions your referral (or is tracked through your link)
• The client becomes a paying customer and completes payment
• The project or service is successfully delivered and completed

3.3 What Does NOT Qualify

Commissions will NOT be paid for:

• Self-referrals (referring yourself or your own business)
• Referrals that were already in contact with JosongTech before clicking your link
• Refunded or cancelled projects
• Fraudulent or invalid referrals
• Referrals that violate our Terms of Service

4. Tracking & Attribution

4.1 Affiliate Links

Upon acceptance into the Program, you will receive a unique affiliate link or tracking code. You must use this link when promoting JosongTech's services. Only referrals tracked through your unique link will be attributed to you.

4.2 Cookie Duration

Referrals are tracked through cookies and other tracking methods. The attribution window is typically 90 days from the initial click, meaning if a client clicks your link and becomes a customer within 90 days, you will receive credit for the referral.

4.3 Manual Attribution

If a client mentions your name or referral code when contacting us (even if they didn't click your link), we will make reasonable efforts to attribute the referral to you, provided the client confirms the referral source.

5. Payment Terms

5.1 Payment Schedule

Commissions are paid after:

• The referred client has made full payment for their project or service
• The project or service has been successfully completed and delivered
• Any refund period has passed (typically 30 days after project completion)

Payments are processed monthly, typically within 30 days after the end of each month in which commissions were earned.

5.2 Payment Methods

Commissions can be paid via:

• Bank transfer (for Kenyan affiliates)
• Mobile money (M-Pesa, Airtel Money, etc.)
• Other payment methods as agreed upon

5.3 Minimum Payout

There is a minimum payout threshold of KES 5,000 (or equivalent). Commissions below this amount will accumulate until the threshold is reached.

5.4 Tax Obligations

Affiliates are responsible for reporting and paying any applicable taxes on commissions received. JosongTech may be required to provide tax documentation for commissions paid, as required by law.

6. Affiliate Responsibilities

6.1 Promotional Guidelines

When promoting JosongTech's services, you agree to:

• Accurately represent our services and capabilities
• Not make false or misleading claims about our services
• Use only approved marketing materials and messaging (when provided)
• Comply with all applicable advertising and marketing laws
• Not engage in spam, unsolicited emails, or other prohibited marketing practices
• Respect intellectual property rights and use our branding appropriately

6.2 Prohibited Activities

You may NOT:

• Create fake accounts or use fraudulent methods to generate referrals
• Use paid advertising on search engines using JosongTech's trademarked terms (without written permission)
• Engage in any activity that could damage JosongTech's reputation
• Violate any applicable laws or regulations
• Misrepresent your relationship with JosongTech
• Use automated systems or bots to generate clicks or referrals

7. Program Modifications

JosongTech reserves the right to modify, suspend, or terminate the Affiliate Program at any time, with or without notice. We may also change commission rates, payment terms, or other program features with reasonable notice to active affiliates.

If significant changes are made to the Program, we will provide at least 30 days' notice to active affiliates. Continued participation in the Program after such changes constitutes acceptance of the modified terms.

8. Termination

8.1 Termination by Affiliate

You may terminate your participation in the Program at any time by providing written notice to JosongTech. You will continue to receive commissions for referrals that were completed before termination.

8.2 Termination by JosongTech

JosongTech may terminate your participation in the Program immediately, without notice, if you:

• Violate these Terms and Conditions
• Engage in fraudulent or illegal activities
• Damage JosongTech's reputation or brand
• Fail to generate any valid referrals for an extended period (12+ months)
• Violate any applicable laws or regulations

Upon termination, you will forfeit any unpaid commissions if termination was due to violation of these terms. If termination is for other reasons, you will receive commissions for completed referrals.

9. Limitation of Liability

JosongTech shall not be liable for any indirect, incidental, special, or consequential damages arising from your participation in the Affiliate Program. Our total liability shall not exceed the total commissions paid to you in the 12 months preceding any claim.

JosongTech does not guarantee that you will earn any specific amount of commissions or that the Program will be available at all times.

10. Relationship of Parties

You are an independent contractor, not an employee, partner, or agent of JosongTech. This Agreement does not create any partnership, joint venture, or employment relationship. You have no authority to bind JosongTech to any agreements or obligations.

11. Dispute Resolution

Any disputes arising from this Program will be resolved through good faith negotiation. If a resolution cannot be reached, disputes will be subject to the laws of Kenya and the exclusive jurisdiction of Kenyan courts.

13. Acceptance of Terms
